Terms of Service

These Terms of Service ("Terms") govern your use of ZyntForms, the form builder platform operated by Zyntel Co. Limited ("Zyntel"). By accessing or using ZyntForms, you agree to these Terms.

1. Service description

ZyntForms is a multi-company form builder with AI-assisted form generation, QR code sharing, team collaboration, and integrated payment collection for East African organisations. It is operated by Zyntel Co. Limited, a company incorporated in Uganda.

2. Free plan

ZyntForms offers unlimited forms on the free plan with no cap on form count. Zyntel reserves the right to introduce response volume limits or premium features with advance notice to existing users.

3. Accounts and access

• You must provide accurate information when creating an account.
• You are responsible for maintaining the confidentiality of your account credentials.
• Multi-company accounts: you are responsible for all activity by users you invite to your organisation.
• You must notify us immediately of any unauthorised use of your account.

4. Acceptable use

You agree not to use ZyntForms to:

• Collect information from individuals without their knowledge or consent
• Create forms designed to deceive, defraud, or harm respondents
• Collect sensitive personal data (financial, health, government ID) without appropriate safeguards
• Violate any applicable laws including Uganda's Data Protection and Privacy Act 2019
• Send spam or unsolicited communications using form response data
• Interfere with or disrupt the service or its infrastructure
• Use payment forms to collect money for fraudulent, illegal, or prohibited goods and services

5. Your data and respondent data

You own all forms you create and all responses collected through those forms. Zyntel does not access response data except as necessary to provide the service. You are responsible for ensuring that your collection of respondent data complies with applicable privacy laws and that respondents are informed about how their data will be used.

5A. Payment forms and creator payouts

How payment collection works: When you enable payment collection on a form, respondents pay through Pesapal (a licensed Ugandan payment service provider). The full payment amount is received by Zyntel's Pesapal account. Zyntel deducts a platform fee (3.0% for Pay-As-You-Go accounts; 1.5% for Pro subscribers) and automatically disburses the remaining amount to your nominated payout account within 2–4 hours of confirmed payment.

Payout credentials you provide: To receive disbursements, you must provide accurate payout details — either an MTN Mobile Money number, an Airtel Money number, or your bank account details (bank name, branch code, account number, and account holder name). By saving payout details on zyntForms, you:

• Confirm that you are authorised to receive funds into the nominated account
• Consent to Zyntel sharing these details with Pesapal solely to execute disbursements
• Accept responsibility for providing accurate and current payout details — Zyntel is not liable for failed disbursements caused by incorrect account information you provide

Platform fee and pricing: The applicable platform fee is displayed in your form settings before you publish a payment form. Zyntel reserves the right to adjust platform fee rates with at least 30 days' advance notice to active creators. Fees already incurred on completed transactions are not retroactively affected.

Payout timing and failures: Zyntel will make reasonable efforts to disburse funds within 2–4 hours of confirmed payment. In the event of a payout failure, Zyntel's automated system will retry up to 5 times over a 24-hour period. If disbursement cannot be completed after repeated attempts, Zyntel will contact you to resolve the issue. Zyntel is not liable for delays caused by the recipient mobile network or bank.

Your responsibilities as a payment form creator: You are responsible for any tax obligations arising from payments collected through your forms. You must comply with Uganda Revenue Authority requirements for income you receive. Zyntel does not withhold tax on creator payouts and does not provide tax advice.

Record-keeping: Payout records, platform fees, and transaction details are retained for 7 years as required by Ugandan financial regulations. You can view your payout history at any time in your form dashboard.

6. AI form generation

ZyntForms includes AI-assisted form generation. Generated forms are a starting point — you are responsible for reviewing and editing any AI-generated content before publishing. Zyntel does not guarantee the accuracy, completeness, or appropriateness of AI-generated form content.

7. Intellectual property

ZyntForms, including its software, design, and AI capabilities, is owned by Zyntel Co. Limited. You retain ownership of your forms and response data. You grant Zyntel a limited licence to process your content solely to provide the service.

8. Service availability

Zyntel will make reasonable efforts to maintain service availability. We are not liable for downtime caused by third-party infrastructure, internet disruptions, or force majeure events.

9. Limitation of liability

To the maximum extent permitted by applicable law, Zyntel shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use ZyntForms. Our total liability for any claim shall not exceed the amount you paid to us in the 12 months preceding the claim.

10. Termination

You may terminate your account at any time by contacting [email protected]. We may suspend or terminate your access for violation of these Terms.

11. Changes to terms

We may update these Terms from time to time. Material changes will be communicated via email at least 14 days before taking effect.

12. Governing law

These Terms are governed by the laws of Uganda.
